01Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Pixel Fusion Pro, LLC ("Pixel Fusion Pro," "we," "us," or "our"). They govern your use of our mobile games — including Ludo Unbound, Quantum Collapse, Quantum Tic Tac Toe, and Celestia — and this website (together, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

02Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms.

03License to use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Games on a device you own or control, and to access the Site, for your personal, non-commercial entertainment. All rights not expressly granted are reserved by Pixel Fusion Pro.

04Accounts

Some features may require a profile or account. You are responsible for the accuracy of information you provide and for activity that occurs under your account. Keep your credentials secure and notify us promptly of any unauthorized use.

05In-app purchases & virtual items

• Games may offer optional in-app purchases and virtual items (such as coins, cosmetics, or upgrades). These are processed by the Google Play Store or Apple App Store, and their terms and payment methods apply.
• Virtual items and currencies have no real-world value, are licensed (not sold) to you, and cannot be redeemed for cash except where required by law.
• Except where required by law or the app store's policies, all purchases are final and non-refundable. Refund requests are handled through the applicable app store.
• We may modify, manage, or discontinue virtual items or currencies at any time.

06Acceptable use

When using the Services, you agree not to:

• Cheat, use unauthorized bots, exploits, or modifications, or otherwise interfere with fair play;
• Reverse-engineer, decompile, or attempt to extract source code, except where permitted by law;
• Disrupt, overload, or attempt to gain unauthorized access to the Services or their systems;
• Harass, threaten, or harm other users, or post unlawful, hateful, or infringing content;
• Use the Services for any illegal purpose or in violation of these Terms or applicable law.

07User content

Some Games let you submit content such as usernames, chat messages, or streamed material ("User Content"). You retain ownership of your User Content, but you grant Pixel Fusion Pro a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it as needed to operate and promote the Services. You are responsible for your User Content and represent that you have the rights to submit it. We may remove content that violates these Terms.

08Intellectual property

The Services and all related content — including games, artwork, characters, logos, audio, text, and software — are owned by Pixel Fusion Pro or its licensors and are protected by intellectual-property laws. "Pixel Fusion Pro," our logo, and our game titles are our trademarks. You may not copy, distribute, or create derivative works from the Services except as expressly permitted.

09Third-party services

The Services rely on third parties such as Google Play, the Apple App Store, and analytics or advertising providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10Termination

You may stop using the Services at any time by deleting the Games. We may suspend or terminate your access if you violate these Terms or if we discontinue a Game or feature. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

11Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12Limitation of liability

To the fullest extent permitted by law, Pixel Fusion Pro and its members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13Indemnification

You agree to indemnify and hold harmless Pixel Fusion Pro from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Services, your User Content, or your violation of these Terms or applicable law.

14Governing law & disputes

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New York will have exclusive jurisdiction over any dispute not subject to arbitration or small-claims court, unless applicable law provides otherwise. Nothing in these Terms limits any consumer rights that cannot be waived under the law of your country of residence.

15Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
